TERMS & CONDITIONS
At MAARCOM, we are committed to conducting transparent and professional international trade. Below are the detailed terms and conditions governing our export operations:
1. Product Details

All our products are handmade or semi-handmade and may show minor variations in size, color, texture, or finish due to the artisanal nature of production.

Customizations can be accommodated based on feasibility and must be confirmed in writing before production.
2. Pricing & Currency

All prices are quoted in USD, EUR, or INR, depending on the buyer's preference.

Prices are generally based on FOB (Free on Board) or CIF (Cost, Insurance, Freight) Incoterms, which will be clearly specified in the quotation or pro forma invoice.

Prices are subject to change due to fluctuations in raw material costs, exchange rates, or logistics fees. Any change will be communicated in advance.
3. Minimum Order Quantity (MOQ)

Once an order is confirmed and advance is received, the order cannot be cancelled.

Each product has a defined Minimum Order Quantity, which will be shared in the quotation.

Bulk discounts may apply for higher quantities.

All terms and conditions need to be in written within the INVOICE and PACKING LIST.
4. Payment Terms

Standard payment terms: 50% advance at the time of order confirmation and 50% before shipment.

Accepted payment methods: Telegraphic Transfer (TT), Bank Transfer, or Letter of Credit (LC) for large orders.

Late payments may incur additional interest charges or cause shipment delays.
5. Production & Delivery Timeline

Lead time depends on product type, order volume, and customization.

General production timelines range between 30 to 90 days after receiving the advance payment and final design/sample approval.

Delivery dates are estimated and may vary due to unforeseen circumstances (e.g., delays in raw material supply or logistics issues) which will be informed in advance.
6. Shipping & Logistics

Shipping terms (FOB, CIF, etc.) and responsibilities will be mutually agreed upon before order confirmation.

Port of loading: Usually Mundra Port, Nhava Sheva (JNPT) or Kolkata Port Trust unless specified otherwise.

We assist with shipping arrangements and provide tracking once the goods are dispatched.
-
Any customs duties, taxes, or import charges in the destination country are the responsibility of the buyer.
7. Quality Assurance

We follow a 3-level inspection process: raw material check, in-process quality checks, and final pre-dispatch inspection.

Third-party inspections (SGS, Intertek, etc.) can be arranged on request, at the buyer's cost.

Sample approvals are mandatory before initiating full production.
8. Returns & Claims

We are not liable for damage caused during transit unless insurance was arranged by us as its beyond our control.
9. Documentation Provided
We provide all standard export documentation, including:

Commercial Invoice

Packing List
-
Bill of Lading or Air Waybill

Certificate of Origin
-
Fumigation Certificate / Phytosanitary Certificate (for wooden products)

Any additional documentation as required by the buyer or the importing country needs to be mentioned before the confirmation of the order.
10. Intellectual Property

Any designs, specifications, or proprietary information shared by the buyer will be treated as confidential.

We will not share, reproduce, or use client-provided designs without prior written consent.

Similarly, our in-house designs, images, and branding are protected and may not be used without permission.
11. Force Majeure
-
We shall not be held liable for failure to perform obligations due to circumstances beyond our control such as:

Natural disasters (earthquakes, floods)
-
War, riots, or terrorism
-
Government restrictions or bans
-
Strikes or labor shortages
-
Pandemic or epidemic outbreaks
12. Governing Law & Jurisdiction

All contracts and transactions are governed by Indian law.

In case of any dispute, the matter will be subject to the exclusive jurisdiction of the courts in India.
-
Alternative dispute resolution through arbitration may be considered before initiating legal proceedings.
